The most significant difference is that the current four-day course and examination required to become a qualified first-aider will become a three-day course and examination. Requalification will still be required every three years and that will involve a minimum of 12 hours tuition followed by an examination, effectively a two-day course. A second category of first-aider training is introduced, called Emergency First-aid at Work. This involves a one day course and examination every three years and is similar to the current (non-regulated) Appointed Person course. For both types of first-aider, a new requirement is that after the first and second year of a certificate&rsquo;s validity, first-aiders will be expected to undergo a skills update course lasting a minimum of three hours. HSE plan to issue revised guidance to help employers decide which course is more suitable.  Updated notification under CDM The Construction (Design and Management) Regulations 2007, known as CDM, contain obligations to notify the Health and Safety Executive of certain projects, eg those lasting 30 days or more, or involving more than 500 &lsquo;person days&rsquo; of work. When the regulations first took effect, they carried forward the paper-based notification system that prevailed in the earlier (1994) version of the law. This is now amended to enable electronic notification as an option. Both the new e-form, and the paper version of F10 for those who prefer the traditional manual input method, can be accessed at https://www.hse.gov.uk/ forms/notification/index.htm  New guidance on diesel engine exhaust emission A second edition of Health and Safety Executive booklet HSG187 &lsquo;Control of diesel engine exhaust emissions in the workplace&rsquo; has been published. There are two parts to the booklet: the first is about how to assess risk and introduce appropriate control measures; the second part is a selection of good working practices suitable for areas such as warehouses, garages etc. The document is available from HSE Books ISBN 9780717663064 (tel: 01787 881165) at a cost of £8.95.  Enforcement action Jailed for manslaughter In August 2008, Norwich Crown Court ordered that Sharaz Butt, director of Alcon Construction Ltd, be sent to prison for 12 months after he pleaded guilty to a charge under s.37 of the Health and Safety at Work etc. Act 1974. The case follows the death of an employee, Wu Zhu Weng, who fell four metres through a skylight in January and died as a result of his injuries. The court heard that Butt had a flagrant disregard for workers&rsquo; safety and had not prepared a risk assessment or method statement for the work. There had been no training, and there was no safe way of accessing the workplace. It transpired that the dead man had also been illegally employed. This conviction demonstrates that legislation pre-dating the much-heralded Corporate Manslaughter and Corporate Homicide Act 2007 can be effectively used against rogue directors.  Extended jail risk for drivers using mobiles New guidelines have been published by the Sentencing Guidelines Council, which courts are obliged to follow, concerning the punishment for causing death by dangerous driving when using a mobile phone. The sentence can now be up to seven years imprisonment where the seriousness merits this, such as texting whilst driving. In addition, a prison term is advocated for drivers who cause deaths because they were briefly distracted by a mobile phone or some other avoidable activity, even though they may not have been engaged in a conversation.  Ladder owner avoids liability for user&rsquo;s fall At the Court of Appeal, an employer has successfully challenged a Queen&rsquo;s Bench judge&rsquo;s ruling that he was partly to blame for an injury to a contractor who fell off a ladder found at his premises.The facts were that a contractor had been sent to service electrical equipment that was on the wall of a room owned by East Potential Ltd. He accessed the equipment by use of a ladder he found in the room. His own employer, Satelcom, claimed that the host employer was partly to blame because the ladder came within that employer&rsquo;s control, and the original judgment agreed with this. At appeal, however, the court said that in the absence of a finding that East Potential owned the ladder, it was hard to see what they could have done other than ensure it was not in anyone&rsquo;s way. For the purposes of the Provision and Use of Work Equipment Regulations 1998, they had control of the ladder only to the extent that they could have moved it or affixed a sign saying it was not to be used. Full liability for the injury was therefore passed to Satelcom Ltd and Intact Networks Limited and no blame attached to the host employer on this occasion.  Fire safety contravention leads to large fine Hendon Magistrates&rsquo; Court handed down fines and costs totalling £23,500 to retailer JJB Sports after a fire brigade inspection discovered six breaches of the Regulatory Reform (Fire Safety) Order 2005. These included locked fire escapes, and escape routes obstructed by stock. Employees were found not to have had any fire prevention training. The company had already had a visit two years previously and had been ordered to improve, but clearly they did not take the necessary actions and this will have influenced the decision to prosecute and the severity of the penalty.  Industry news Asbestos awareness campaign The Health and Safety Executive are spearheading a national campaign to raise awareness amongst tradesmen of the hidden dangers from asbestos. Starting on 13 October, there will be adverts in national newspapers, on national radio, and via leaflet distribution. There will also be case studies in trade magazines. All of this is to make workers aware that they may be at greater risk than they think, and to offer advice on finding out more about asbestos and the necessary precautions.  CoRGI&rsquo;s bark to fall silent The Council of Registered Gas Installers, CoRGI, has lost out in a bid to carry on running the registration scheme for those involved in gas installations and maintenance. The Health and Safety Executive has awarded the new contract to Capita, and it is due to start in April 2009.  European Week of Safety &amp; Health European Week runs from 20-24 October, and the theme is the demystifying of risk assessments to show that they are necessary and worthwhile and not an overly-complicated process. Organisations will be encouraged to make informed decisions, and to concentrate on risks that cause real harm and suffering as opposed to trivial and everyday risks of little consequence. Further details, and free &lsquo;action packs&rsquo; are available from HSE&rsquo;s website at www.hse.gov.uk/campaigns/index.htm  IOSH survey says workers approve of safety laws According to the findings of a YouGov survey commissioned by the Institution of Occupational Safety and Health (IOSH), 65% of respondents said they believed that health and safety at work either saved people&rsquo;s lives or helped to prevent ill-health and injury. Around 28% thought it was about red tape, unnecessary European laws, or preventing people from going about their daily lives. Nearly seven out of ten people said that compliance with workplace health and safety rules and regulations did not interfere with their ability to do the job. In a separate survey also run by YouGov for IOSH, more than a quarter of employees said that they would report their employer to the enforcement authority if the organisation had broken safety laws.  Fire safety of common areas in residential accommodation A guidance booklet has been published by the Local Authorities Coordinators of Regulatory Services (LACORS) to try and explain how to improve fire safety in certain types of residential buildings in England. The guidance was necessary to avoid possible conflict and duplication of enforcement &ndash; there is a legislative overlap between the Housing Act 2004 and the Regulatory Reform (Fire Safety) Order 2005. The guidance affects, for example: single household properties, shared houses, sheltered accommodation in which personal care is not provided. It applies to these premises regardless of tenure (e.g private ownership, social housing and the private rented sector). Importantly, premises built or converted to standards in the Building Regulations 1991, and still meeting those standards, are not subject to the new guidance. TUC says economic downturn may affect workers&rsquo; health The Trades Union Congress (TUC) has warned that health, as well as ongoing employment, is likely to be put at risk in the current economic climate. With up to 3.3 million employees said to be concerned that they may not still have a job this time next year, attention has been drawn to the correlation between insecurity and higher rates of work-related accidents, sickness and heart disease. Employers should be vigilant and ensure that management strategies for minimising and recognising stress at work are sufficiently robust. Conveying the wrong message&hellip; Workers in the baggage handling section of Stockholm&rsquo;s Arlanda Airport had a bit of a surprise on 26 August when an elderly woman came through the baggage chute for sorting. It seems she mistook instructions at check-in, and thought that she was supposed to get to the plane by conveyor! The 78-year-old lady was en-route to Germany when she sat down on the on the unmanned belt and was promptly whisked off to the baggage handling centre. Staff helped get her back to the correct location and, uninjured, she made her flight as planned. There are no reports as to what became of her luggage! The Control of Noise at Work Regulations 2005 came into force for all industry sectors in Great Britain on 6th April 2006 (except for the music and entertainment sectors where they came into force on 6th April 2008). The aim of the Regulations is to ensure that workers' hearing is protected from excessive noise at their place of work. Exposure to high noise levels can cause hearing loss and conditions such as tinnitus (permanent ringing in the ears). These new regulations place more stringent requirements upon the amount of noise to which workers can be exposed. Employers must provide hearing protection and hearing protection zones when workers exceed the Upper Exposure Action Value (which is a daily or weekly exposure of 85dBA or more). Above the Lower Exposure Action Value (which is a daily or weekly exposure of 80dBA or more), employers must assess the risk to workers' health and provide them with information and training. There is also an Exposure Limit Value of 87dBA, taking account of any reduction in exposure provided by hearing protection, above which workers must not be exposed. Noise risk assessments are essential to understand whether working conditions conform to these new regulations.  Noise Risk Assessments: Measuring Sound Level The regulations are designed to protect individuals from damage to their hearing, both from exposure to sustained levels of noise over a working life, and from very high impulses of noise, which can give instant damage. With this in mind, measurements are taken which assess the average exposure an individual is subjected to throughout the day and also measure any &lsquo;peaks&rsquo; of noise which could result in instant hearing damage.  Why use an RSA Consultant for Noise Risk Assessment? The new Control of Noise at Work Regulations 2005 call for the use of &lsquo;expert intermediaries&rsquo; meaning an employer should rely on competent third parties where they themselves are not competent for the relevant aspect of noise in the workplace. Noise risk assessment can be very complex and you need the right combination of training and experience to be considered as competent. RSA &rsquo;s consultants are members of both the Institution of Occupational Safety and Health as well as the Institute of Acoustics, which is the gold-standard of competency in noise assessment. Consultants such as those at RSA use only modern, data logging sound level meters. Old sound level meters or very simple units give only an instantaneous level of noise in decibels, which makes it difficult to look at the value on the display and assess an average value. This problem is compounded by the fact that machine noise that sounds &lsquo;steady&rsquo; to the ear can vary by 3dB. A 3dB increase is a 100 per cent increase in noise energy, meaning that large errors can be made if an accurate average is not measured. This is why modern sound level meters have an averaging feature called Leq. This is called the equivalent continuous sound energy level. As this value uses the &lsquo;A&rsquo; weighting, this is normally displayed as LAeq when written down.  Noise Risk assessment: How do we Calculate Noise? In order to compare different industries and shift times in a way that the same action levels can be used, noise exposure is standardised to an eight hour working day value called LAEP,d (&lsquo;daily personal noise exposure). When measuring the LAeq it is important to measure for a period of time that is representative of the employees&rsquo; exposure and what the exposure time is for that noise. If an employee performs different jobs (and hence experiences differing noise levels) it will be necessary to repeat this for each different job, noting the exposure time for each. If people are likely to be exposed to high levels of impulsive noise, such as noise emitted from heavy pressing operations or sheet metal working, then the peak noise must be measured.  Noise Risk assessment: Two Approaches to Noise Assessment The two main methods for the measurement of noise are either to use a sound level meter or a noise dosimeter. A sound level meter is primarily designed as a hand held meter, whereas the noise dosimeter is worn by an employee for his or her working shift. A common misconception is that if you have to measure noise dose, you use a dosimeter. In fact the HSE&rsquo;s preferred method of measurement for noise surveys is to use a sound level meter. There are several reasons for this, primarily because when performing a noise survey with a sound level meter the operator is present and measuring the noise of the employee. This ensures there are good quality measurements that are repeatable. With a sound level meter, a representative measurement is made for each job function and the exposure time for each, and from there the eight hour exposure can be calculated. The more complex the work pattern of an employee becomes, the more the difficulty to assess the noise dose using a sound level meter is increased because more and more measurements would need to be taken in order to calculate noise dose. A noise dosimeter consists of a microphone on a cable, which can be clipped to the lapel or collar. The dosimeter can then be started at the beginning of the shift. Another useful feature of noise dosimeters is that they will &lsquo;log&rsquo; the noise data so that, when downloaded to a PC, the time history of the noise can be viewed. This gives the ability to analyse when and where high noise exposures occur through a shift. This can be even more useful when the dosimeter can be placed on an employee who is prepared to make a diary of what times and jobs he or she was performing throughout the day. This will give the employer the ability to directly see which operations most need noise control in order to reduce noise exposure. How RSA can help with fire risk assessments   What does the Regulatory Reform (Fire Safety) Order 2005 require? The aim of the Regulatory Reform (Fire Safety) Order 2005 (RRFSO) is to simplify, rationalise and consolidate existing fire safety legislation. The new regime is effective from 1st October 2006 and affects those who are responsible for non-domestic premises, such as employers or owners. Self-employed people and the voluntary sector will also be brought within this regime. The main effect of the RRFSO is a move towards greater emphasis on fire prevention in all non-domestic premises. Fire certificates are abolished and cease to have legal status as from 1st October 2006. The Fire Safety Order applies in England and Wales. (Northern Ireland and Scotland will have their own laws.) It covers 'general fire precautions' and other fire safety duties which are needed to protect 'relevant persons' in case of fire in and around most 'premises'.  Who is responsible for Fire Safety and Fire Risk Assessments? Responsibility for complying with the Fire Safety Order rests with the aptly named 'responsible person'. In a workplace, this is the employer and any other person who may have control of any part of the premises, e.g. the occupier or owner. In all other premises the person or people in control of the premises will be responsible. If there is more than one responsible person in any type of premises, all must take all reasonable steps to work with each other. If you are the responsible person you will have to carry out or arrange for a fire risk assessment to be carried out which must focus on the safety all 'relevant persons' in case of fire. It should pay particular attention to those at special risk, such as the disabled and those with special needs, and must include consideration of any dangerous substance likely to be on the premises. Your fire risk assessment will help you to identify risks that can be removed or reduced and to decide the nature and extent of the general fire precautions that you need to take to protect people against the fire risks that remain. If you employ five or more people you must record the significant findings of any fire risk assessments.  What are the Main Requirements of the Order? The responsible person is required to: Carry out or nominate someone to carry out a fire risk assessment identifying the risks and hazards. Consider who may be especially at risk. Eliminate or reduce the risk from fire as far as is reasonably practical and provide general fire precautions to deal with any residual risk. Take additional measures to ensure fire safety where flammable or explosive materials are used or stored. Create a plan to deal with any emergency and, in most cases, document your findings. Review the findings as necessary.  Generally the requirements of the Order will be little different from those already imposed under previous legislation in that it will require the responsible person to carry out fire risk assessments, produce a policy, develop procedures, provide staff training and carry out fire drills. Legionella Sampling Our consultants can carry out water sampling and testing for legionella. Legionella bacteria are common in natural water courses such as rivers and ponds. Since legionella are widespread in the environment, they can contaminate and grow in other water systems such as cooling towers and hot and cold water services. They survive low temperatures and thrive at temperatures between 20&deg;c - 45&deg;c if the conditions are right, e.g. if a supply of nutrients is present such as rust, sludge, algae and other bacteria. We offer a full range of health and safety training courses, providing both bespoke training and nationally recognised qualifications in health and safety. Our experienced training specialists can design and deliver the perfect programme to meet your needs, for the boardroom or the shop floor in any type of organisation. If you can&rsquo;t see the safety training course that need on our website, just contact us and we should be able to help you.  Where are the courses held? At a location to suit you. Most clients prefer to hold the training in-house on their own premises but we are happy to run courses for you off-site, perhaps in a local hotel. We have our own training suites in Northamptonshire and in Kent which you would be welcome to use.  Do delegates get any form of certification? All the nationally recognised courses conclude with an examination (optional). Successful candidates receive certificates from the awarding body. Certificates of attendance or achievement can be issued to delegates attending all other courses.  How soon can you deliver? Usually within 4-6 weeks depending on the course required and current availability.  What is the cost? Prices vary according to course to be delivered. For example, the First-Aid at Work Certificate is as little as £1100 for up to 12 people &ndash; that&rsquo;s less than £100 per delegate! We charge for training development and delivery on a daily basis, and will provide you with a written quotation before work begins. Discounts are available where higher volumes of work are placed. Our standard daily rate for training is £775. Nationally recognised courses have additional registration and certification fees. These are advised in advance and passed on at cost.  What training methods do you use? We use a variety of methods during a course, depending on the subject and the course objectives. Our philosophy is to &ldquo;train by doing&rdquo; which means that, wherever possible, we include practical exercises. This enables delegates to put the theory into practice, and see at the same time how it relates to their own workplace. This makes them feel more able and confident to use their newly-learnt skills when back at the workplace.  Who does the training? We have many experienced, qualified trainers. We select the most appropriate trainer for the course content and the delegate group. All trainers undertake consultancy work and can bring that experience to the classroom, citing real workplace examples to illustrate and reinforce learning points.  What is IOSH ? How much do you charge? Fees vary according to the length of a contract and the type of work we are doing. As a guide, our fees for one day&rsquo;s training or consultancy start at £775 plus VAT although we do provide discounted prices for larger jobs. Some services are at lower rates, e.g. first-aid training and fire prevention courses. Discounts are also available to clients subscribing to our Advisor Service. CIEH Principles of Manual Handling: Course details Introduction Principles of Manual Handling is a stand-alone level 1 qualification, which complements the CIEH Foundation Certificate in Health and Safety programme. It is aimed at those who carry out manual handling activities at work and introduces students to the hazards of manual handling, the risks involved and controls available and what to expect from a manual handling assessment. Successful completion will prepare students to look carefully at their own work activities and contribute to the development of safer methods and tasks, in co-operation with their managers and supervisors. The qualification is not intended to train students to carry out manual handling assessments nor to provide detailed training on handling techniques. While this unit of study can be delivered as a stand-alone qualification and there are no specific pre-requisites, it is strongly recommended that students should already hold the CIEH Foundation Certificate in Health and Safety.
